Do not wait for the full impact
FIDIC’s explanation of Sub-Clause 20.2.1 ties the trigger to actual or constructive awareness of the event or circumstance. Do not assume the clock starts only once an effect appears on the critical path. Check the executed contract and Particular Conditions.
Keep a register from the first event
Record the event date, awareness date and evidence for that date. Add the clause, recipient, period and required delivery route. Assign an issuer and a receipt check. A copy of a letter alone does not establish delivery through the agreed channel.
Separate the notice from the detailed claim
A notice identifies the event and the entitlement being reserved. The detailed submission connects facts, contractual basis, programme effects, cost and evidence. Track each step separately against the applicable provision.
What if a notice is late?
Assess the applicable clause, edition, amendments, earlier responses and governing law. Do not treat every late notice as having the same consequence. Preserve the evidence, avoid further delay and obtain a contract-specific assessment.
